No matter what the cause is, there has to be consequence for the murder. It satisfies human need for justice and it teaches the lesson to others who want to do that. Just because people disregard their and other's mental health does not give them an excuse to murder someone.
What you're basically saying is "Oh no that person who killed those 10 children is mentally disabled, because we're in 21st century he should just stay in prison". How do you think those 20 parents feel about that? You do realise a lot of murders happen because of the revenge, right?
You don't realize how many murders would there be if everyone could get away with it.
You act like you're on higher moral ground but I'd like to see your reaction if murderer got several years of prison for killing someone you care about.

which is why America doesn't have any murder at all and all the crazies immediately stopped being crazy the instant they realized that they could go to jail! also nobody had to knife and mug anyone else ever again, because the extra money being spent on all that due process somehow meant that people had to pay [I]less[/I] taxes and had all the money they needed! hooray, you've solved crime forever!

I'd imagine I would be angry, irrational, deeply disturbed both physically and mentally, generally unpleasant to experience the company of, and disillusioned with the concept and value of life - exactly the kind of person who shouldn't be judge, jury, or executioner, funny enough.
