Hence the downloading itself is usually seen as unlawful enrichment at most if anything. The criminal part is usually uploading the file (enabling others to commit a crime). Of course due to the the nature of p2p software that's more or less impossible to avoid.

Alright, so it's gotten thus far. Now we're going to use other means of getting music illegally, without them knowing. Seriously, it's not going to stop. 1xDumb for whomever may have been signing it.

Or just a shitload of locks on a thick metal-reinforced door that can't be busted down in seconds. Preferably one that opens outwards. Say you'll go get a key, be back in a minute. Press the wipe button, pulverize the hard drives, flush them down the toilet. Then it turns out they weren't cops, but rather a pair of plumbers.
This doesn't change the piracy situation one bit. If the US can't enforce this for shit, what makes anyone think adopting countries will even give a shit to enforce it properly. Edit: How bout a bluetooth deadmans switch. Maybe integrated into an app on your iphone that looks like its for connecting to your car stereo. The bluetooth switch sets off chemicals that you've pre-planted in your hard drives, dissolving all written information on the disks. Maybe even an acid strong enough to eat through the metal. This way, you can set it off right in front of the dumb asses looking at your computer, and they'd never know until it's too late to convict you with any proof.

But there is only one flaw. What about the music that isn't posted on the internet for purchase? And what if we also can't find this music in stores to buy on vinyl or CD? What do? Sometimes downloading 'illegally' is the only way to get a song that you love. Everyone does things that other people wouldn't deem to be 'right' but it's not always a black and white circumstance.
I'll always keep in mind all these persons sued for having downloaded the demo of Call of Juarez, because the publisher thought it was the actual game.
I'm sure China will love the extra business.

I'm really curious how charging such an exorbitant amount of money for a simple song is justified. You'd figure it'd have to be smaller in accordance with the eighth amendment.
