No, it's not an excuse, but it's a mitigating factor.
And let's all take an important note here: [B]They are not being pardoned[/B] - they are having their sentances suspended. They all still have a criminal conviction for statutory rape, which will be on their criminal records till the day they die. [B]In the eyes of the law, they are still guilty.[/B]
Whether they deserve to have their sentances shortened and suspended is a different matter, but this isn't an argument about whether they committed a crime or not, because they have.

For the sake of being impartial, I'll say this: If it is true (Read: Incredibly unlikely) that the girl on the far end of the park had the men come over for consensual, albeit illegal sex, then this is a case of statutory rape. However, any other, more forceful scenario is indeed gang rape.
