I just showed you three different ways to draw mouse ears. Yes, there is a style to it.
And just like that, you prove that disney's ears and deadmau5's ears look nothing alike, well done.
Disney's just getting pissy over copyrights cause they're gonna lose the rights to the Mouse in 2023. Hell, they've already made huge arguments against copyright laws and won just to keep the Mouse for a couple more decades.
Disney has always wanted to protect the Mouse because since he's so well known, he can be unbelieveably misinterpreted. As this latest generation grows up, they could probably see deadmau5 at a young age, or could be just really bad at interpreting things at later ages, or possibly parents might see this content and immediately associate it with Mickey due to gross misinterpretations of media.
You've gotta understand here, the reason Disney is trying to protect the Mouse is because he has made the company more money than they will ever know. Hell, even Snow White can't hold a candle to what Mickey has done for Disney. His ears are everywhere, on candy bars, ice cream, coloring books, backpacks, you name it. Disney Animators and Designers are trying their best to make sure the mouse ears are always shaped relative to the camera (take a look at this video. Mickey's ears are always in the classic shape no matter how he turns his head. This was to imitate Walt's technique on keeping him identifiable, which has since done well.) The theme park is shaped like the fucking ears. They're so important to their brand and if others are confusing it, Disney starts losing potential customers to knock offs or start associating Disney with something they don't have control of. By word of mouth, that can be absolutely detrimental to a company.
But here's one thing Disney forgot to remember when filing this claim. Deadmau5 has a distinct shape to the face, but the Disney lawyers simply focused on the outline. Mickey Mouse's ears are defined by the outline, which is what is commonly used when abusing this brand, while deadmau5's head is arguably different cause it's focused more on the smile and eyes. The ears also are much larger on deadmau5's head, almost as big as the head on a 2D plane, while Mickey's are smaller and more relaxed. Also, if you turn the mau5 head around, you'll notice no outward shapes, just the teeth indent. Mickey is shaped like a proper mouse, snout and all.

Point is, Disney has some valid claims, but they mostly fall short when you look at the bigger picture. Unless Disney has some vauge rights to the shape of the ears, (which after a quick look through the US Trademark and Copyright online centers, none such found) they have little to no grounds in this case.

heh, mickey looks afraid of deadmau5. how fitting.
Fun fact: Mickey Mouse should actually be in the public domain right now, but Disney spent millions lobbying Congress to up the amount of time before a work enters the public domain by another 30 or so years. The act was even called the "Mickey Mouse protection Act" by people in the industry.
So yeah fuck Disney.
fun fact, just about every time a bunch of stuff is about to go into public domain everybody lobbies congress to change it up, for example, anything from mark twain won't enter public domain until 150+ years after his death
[editline]7th September 2014[/editline]
nothing made in the last century will ever enter public domain because of two reasons
1) the media they were originally copied on will be destroyed and the property lost before we can get it because the industry has held them under lock and key and not paid any attention to them
(IE every movie made before 1940)
2) they'll lobby congress to get a new "extension" act passed which will just extend public domain until fucking infinity
ultimately we loose because even the few very few concessions made such as fair use and parady are often not enough to defend one against a C&D
[editline]7th September 2014[/editline]
also safe harbor is essentially the telecom's liability free card which we as normal people don't get the right to use

you know I'm really hoping our new age of technology and the internet and such will affect how this all turns out the next time Disney or whoever tries to defend their properties.
