So, if the terrorists who were working on 9/11 were uncovered and stopped before the action itself happened but had all the plans ready couldn't be persecuted, because they aren't aiming anybody specific, just a country, and that's not a crime.

"the usa in general" isn't something you can attack, and simply saying "you're going to pay" isn't a a plan. if these people were actually planning on committing an act of terrorism, they probably wouldn't be shouting about their plan in front of a government building
