No, a plea bargain is a guilty plea without the harsher sentence. 90% of cases end of in a plea bargain, usually because the defendant is guilty.

He plead guilty to a lesser crime, and the girl and her family was satisfied with it, as it was some punishment, and I can imagine that a rape victim wouldn't like talking about her rape over and over and over again in front of strangers who will criticize every fucking aspect of it, trying to blame her in any way. ("Drunk? Oh, well rape is acceptable then. You wore a short skirt? Oh, you had it coming." That kind of attitude.)
The girl went back to school, and the school told her basically to act invisible.
The girl didn't feel like she had to be ashamed of being a victim, and didn't feel that she had to quit doing what she liked to do, aka cheerleading, just because she was raped. She just didn't cheer for that one guy.
Her refusing to cheer for that one guy wasn't "substantial interference". It was one girl not participating in a minimal amount of the cheers. Not yelling "FUCK YOU RAKHEEM", but just staying silent. Oh no, one girl is staying silent, EVERYBODY'S GONNA HATE THE SCHOOL NOW.
Yes, being on the cheer team is voluntary. But she shouldn't have to be ashamed of getting raped. She shouldn't have to stop doing what she likes to do. She compromised and decided to just stay quiet during a minimal amount of the cheers. Barely disruptive at all. Hell, most people probably wouldn't even fucking notice. Just because she's not getting paid doesn't mean she can just not do what she has without consequences. Cheerleading is optional. You either cheer for all or don't and fucking quit.

Because plea bargains are usually given to those who can't possibly win a case. Instead of having to put up with the whole case and bog down the system, they can get a lesser sentence, admit to the crime and go do their time instead of going through arduous 5 day to many weeks long process of a trial.

However they are public servants and therefore are part of the government which cannot block one's free speech just because you work under them. It also is not like the child has a choice since its usually one high school per district. It is the parent's decision.

federal court came to the same conclusion though, I can't figure out why nobody (except for Florence) has been up in arms about disbanding the US or giving it back to England/France/Russia/Hawaiian royalty/Mexico yet

sometimes they're given to save the victim from reliving the ordeal all over again and having to testify against the defendant

I don't give a shit that she was dropped from the team. I care that the fucking rapist was allowed back onto the team at all, much less the same school, much less is out of prison at all before she has finished her high school career.
First amendment rights only prevent you from being oppressed by the government. Seeing as that is what the supreme court covers, I am not surprised that they were turned down.
He pleaded down. He was still convicted. The school knows damn well what he did. How does being on probation NOT preclude him from sporting activities? Fucking ridiculous.
So no, my problem isn't with the decision of the Federal courts. It is still with Texas and its unbelievably shitty school system.
