Oh, um, you got me there! I haven't taken in the fact that, well, uh. He's been fucking tried in court and found guilty?
For a lesser crime which he definitely never got punished for because he's still on probation BUT LIVES IN FLORIDA! [editline]7th May 2011[/editline]
there we go, that should have been enough to get a full conviction, but that + a rape kit + dna should absolutely positively win her case over I hope they try to charge him again with every bit of evidence possible
Double Jeopardy is now in effect.
Oh, um, you got me there! I haven't taken in the fact that, well, uh. He's been fucking tried in court and found guilty?
courts find completely innocent people guilty occasionally, not saying this guy was innocent (not by a fucking long shot) but just saying
Stay classy, Texas.
there we go, that should have been enough to get a full conviction, but that + a rape kit + dna should absolutely positively win her case over I hope they try to charge him again with every bit of evidence possible
it's already over, you can't charge people twice for the same crime, double jeopardy is part of the US constitution
After reading through the beginning all I can say is, FUCK Texas and fuck Silsbee!
FUCK all of Pakistan because bin laden lived there!!!!!!!
Rape kits can be intrusive.
So is Rape.
it's already over, you can't charge people twice for the same crime, double jeopardy is part of the US constitution
well fuck, this is a good occasion for vigilantism then
courts find completely innocent people guilty occasionally, not saying this guy was innocent (not by a fucking long shot) but just saying
I know that, But in this case there's more than enough proof that he raped her.
So is Rape.
Well, yeah, duh. Your point being... ?
Ad hominem ok. You know that calling people names doesn't prove anyone's point?
You made an assumption, without reading the actual story's source, that the victim in question either deserved or was at fault for her rape ("Chances are it was her fault"), or wasn't actually raped ("There was no clear proof she was raped.") To start with, the sources in the OP show beyond any reasonable doubt that the event happened. They also provide no reasonable excuse to believe the girl was at fault for the event. So that takes care of factual affairs pretty neatly. Most people with two functioning neurons have a hard time stomaching any argument that a rape victim can be at fault for their own rape, because all arguments of the sort tend to stem from ridiculously sexist beliefs (e.g. that a person is not allowed to dress in a way that "provokes" a sexual response because rapists shouldn't have to control themselves.) The concept of such an argument is in and of itself a horrible dark joke and nightmare, a grand clusterfuck of fallacious reasoning, sexism, and a display of just how horrible some humans are on the inside. So, this leaves two solid possibilities and one highly unlikely one: 1) You are a complete imbecile who doesn't know what words mean and just kinds types to make pretty words appear onscreen. 2) You are backwards enough to make a reflexive judgment, without actually knowing or having read anything about the rape in question, that it either must not have happened, or that the victim was asking for it, proving you are one of the worst types of human alive. 3) You were actually there and have a magnificent argument for your behavior thus far. If you post in here again, it better be "Goofball hyperfish smudge paste volvo credenza" or a detailed explanation of your firsthand experience with this event. That's the only way you're gonna save face on this one.
my god, I just read that article mo-ther fucker
This has nothing to do with free speech. It's like as if I was a doctor and refused to do an operation on a person because he hurt/murdered my friend/family. To not perform your duty is a rebellious act, not free speech. Cheerleading is 100% optional and no one is forced to enroll. If you don't perform your job, you get fired. Nothing to do with free speech. Although if she got raped but the rapist didn't get charged does suck, I still don't feel sorry for her because she didn't perform her duties as a cheerleader, thus got kicked off the team. She sued the wrong person for the wrong reason. The real person she needed to sue was the rapist for rape, not school for free speech rights. But then again, she's a cheerleader, so most probably her brain is as big as the basketball jock.
Last time I checked, cheerleaders don't have to take an oath to cheer for everyone regardless of the circumstance.
my god, I just read that article mo-ther fucker
I hope the media backlash destroys his sports career and drives the school into the ground
Last time I checked, cheerleaders don't have to take an oath to cheer for everyone regardless of the circumstance.
technically they do have to do whatever their coaches/the school tells them to within legal boundaries, and edja did hit the nail on the head with his doctor analogy (note: I do not support the rest of edja's views and please don't associate us), technically they were well within their rights to kick her off the team and technically she legally should have lost the case against the school. But in some cases, technicalities be damned, have a heart you heartless fucks and let her back on the team/kick the rapist off the team/whateva.
I hope the media backlash destroys his sports career and drives the school into the ground
I'm having a hard time finding where this fucker lives. He's either really smart and doesn't like the internet or a too retarded to leave a trail.
:v: Because refusing to hear a case means they actually heard it.
It means the case is baseless and doesn't warrant any more attention. She's suing because she was dismissed by the squad for failing to meet the the duties placed upon her as a public representative as a member of the squad, it doesn't matter the context, membership is a privilege not a right, she has no Free Speech claim what so ever

He's still under probation and lives in Florida now. You can't play sports while under probation in most states. I don't know about Texas but I'm going to guess its the same thing there too which means the school WILLINGLY went against the law. It also did nothing to prevent retaliatory attacks on the victim which means it is legally in trouble for lawsuits. You should've read more about this case before dropping your 10 pound bomb of late and wrong.

Next thing you tell me people can sue Facepunch for them getting permabanned for refusing to follow the rules since they are guaranteed to the Freedom of Speech as a Citizen of the United States
FUCK all of Pakistan because bin laden lived there!!!!!!!
Right next to their military training facility in a mansion. Fuck their government at the very least.
Right next to their military training facility in a mansion. Fuck their government at the very least.
he was saying "FUCK [all of] Texas [because of one single highschool]!", just making a connection but fuck pakistan anyways
This is why I would never live in Texas. They are all fucking crazy.
This is why I would never live in Texas. They are all fucking crazy.
A for effort.
Completely different point from the whole cheerleading thing.
It is, cheer squad membership is the same as forum membership as both are voluntary and aren't required, with the owners of both entities and the admins having the ability to kick or ban you from it for any reason they want, and there's nothing you can do about it
Shine on Texas, you backwards dumb fucks!
How is being dismissed for refusing to fulfill your duties retaliatory?
She was never informed that she was expected to cheer for each player at each event with no possibility of sitting one out, and had sat at least two out before being confronted on the issue.
Turns out that during the cheerleading practice session when the girls were admonished that they had to cheer for every player, the victim had been in one of her rape counseling sessions.
If that and how they did eventually inform her on the spot isn't clearly planned retaliation then I'm a fifty ton albatross.
And life goes on in Dumbfuckistan Place is practically a Ten Commandments state. Those places are even worse then Middle Eastern Sharia States. What a good legal system
She was never informed that she was expected to cheer for each player at each event with no possibility of sitting one out, and had sat at least two out before being confronted on the issue.
It doesn't matter, being on a cheer squad is a privilege and not a right, just like forum membership, you can be ejected for what ever reason the administrators find fit She has no case
