Well technically it wouldn't given the Supreme Court's primary duty is interpretation of the Constitution.
Doesn't really matter, though, given this is the 10th Circuit and they don't have supreme powers over constitutional interpretation.
Thankfully the Supreme Court tends to take their constitutional duties very seriously. The only times I'm aware that they've fucked about are in cases of racist policy.

I'm very sure that if this case were reviewed by the Supreme Court, they too would find it unconstitutional. 14th's equal protection clause doesn't apply to gun ownership, because it's a right that's deniable due to gun control legislation. The 14th is usually what is used to justify the citizenship-blind nature of the Constitution. Oh, and that pretext in the 2nd isn't really in favour of an alien's position.
