Doesn't really matter, though, given this is the 10th Circuit and they don't have supreme powers over constitutional interpretation. The 14th is usually what is used to justify the citizenship-blind nature of the Constitution. Oh, and that pretext in the 2nd isn't really in favour of an alien's position.
