I had a feeling Flake might do something like this. AFAIK he didn't say he would 100% vote against Kavanaugh without a full FBI investigation though
If he does get confirmed. Giving the supreme court conservative control. Couldn't Brett just reopen it and strike it down?
The oral argument will be October 5, Brett can't vote on it if he doesn't hear the oral argument.
So is the FBI investigation going to go through? And has it been confirmed the vote will be delayed by a week?
Uncertain. Basically, it comes down to whether Flake and whoever is backing his play follow through with their threat. If they do in fact mean to say that they would vote 'No' on any vote brought to Senate before said investigation then the GOP simply doesn't have the votes to confirm Kavanaugh -- which would mean bringing it to the floor would mean bringing it to the floor to be rejected.
Yeah, let me just go take a short walk from Oregon to Washington fucking DC. Doing anything local would be 110% pointless. Oregon's senators are already against Kavanaugh being confirmed. The only federal level politician Oregon has that would probably be in favor of Kavanaugh being confirmed is the representative for the eastern district, the only Republican rep we currently have and a corrupt piece of shit. Can SC Justices actually choose to open cases themselves? I actually don't know so this is a legitimate question for someone who does. In my opinion they shouldn't. Seems like it'd be far too easy for them to abuse that ability to flood the court with the same request repeatedly or just drown the court in cases so others don't get heard.
The Supreme Court chooses what to hear, they get petitions and if four or more of the justices want to hear it they do so. Chief Justice Earl Warren specifically instructed his clerks to look for cases to overturn precedent, and he was behind the liberal court in the 60s.

And it's not Mitch - or the Senate - who can direct the FBI to reopen the case. Only the White House can order that background check re-opened.

But with Merkowski(sp?) and Flake both saying they will vote No if Mitch lets that happen and Trump refuses to re-open that check, well - here's the math: 51 Republicans in the Senate. 51 to Confirm if all the Democrats vote No. Flake and Merkowski(sp again?) vote No. That's 49 Votes for Yea; that means Kavanaugh is rejected.

That would be a very bad idea. He's also stating he only wants to talk to the FBI if what he states 'remains confidential' -- meaning what he wants to say about Kavanaugh is something he doesn't want Kavanaugh to hear him saying.
I mean this is the fucking GOP we're talking about. It would not surprise me at all if they pull something extremely retarded, but if he's actually wanting to reveal confidential information that can take this fucker Kavanaugh down. Then God Speed.

He probably wanted to post about how the Judiciary Committee had just sent out a request to the White House to re-open the investigation -- and I ninja edit'd it into my post before they posted.

My biggest fear in all this is that Collins, Murkowski, and/or Flake are looking to just get an investigation through so that they can vote in favor of Kavanaugh with less backlash.
I've felt that too, and have been cautiously optimistic all day, but the most recent news about Mark Judge is probably the most hopeful I've been yet, on top of the delayed vote.
