It's not up to Flake anymore. There's enough votes that even if he did, it would still fail.

Does the FBI have to do the usual proving beyond reasonable doubt that a crime has occurred? After all these years, is there a mechanism by which they can do that? I'm not well versed in the annals of long/cold cases.
from what I understand in this case the FBI isn't going to issue any kind of recommendation. All they can do is gather testimony from the witnesses/those involved and then pass it on to the Senate. I don't think you'll be able to prove it happened in this case.
This isn't a criminal investigation, but background investigation for a job interview. If the FBI were being tasked with preparing criminal charges against Kavanaugh, they'd need to meet the high standards of evidence required in criminal cases. This is not the case, they are merely gathering info and providing it to Congress.

Wow, I wasn't able to watch live but apparently there was a huge amount of last minute drama around which way Flake would vote and the Republicans gradually lost their smiles and optimism as he left the room for 90 minutes. It seems like he probably really was swayed by those protesters so this is an example of protest working?

Though it seems Jeff Flake actually had a genuine conscious reconsidering of his life from that confrontation.

Personally I thought it was his fear getting chewed out by his party but now I'm thinking it's him thinking about the interaction he had with the sexual assault victims prior to this and his realization of what he's doing

Here's what really pisses me off about the whole thing: If Ford had reported the sexual assault back then, everyone would have said she was lying and called her horrible names and put Kavanaugh on a fucking pedestal. Now here she is, coming forward, and people are saying she is lying because she didn't report it 30+ years ago and she that she is just trying to smear his name because of his political views. THIS is EXACTLY why most sexual assaults go unreported.
Every single victim deserves so much better than that. It's absolutely deplorable that three women have come forward about their assaults at the hands of Kavanaugh who many people think are lying.
its almost as if time differences don't matter and its the fact that sexual assault victims are treated like dirt no matter what. Just the "30 years" bullshit is just a way to cover up the fact that they're trying to slut-shame a woman for getting raped.
Think about it. He was a popular guy, likely had top grades, and she was a girl at the party, probably not as well-liked as Kavanaugh. And back then, if you reported rape, you were treated like an outcast, especially if it was reported against someone put up on a pedestal (i.e. Kavanaugh). They would think you are trying to smear the popular student's name. That's why there are so many women out there who never reported their rapes/got no justice for what was done to them.
Also on top of they just don't want to have to talk about their sexual assault. They don't want to lay bare the details of what happened to them, they don't want to have to relive it and go into the bits and pieces of what they went through. It happened, and they'd rather just... Move on. Live on. Try to forget it happened. Justice isn't going to take away what happened, because it already did. They're not looking for the "right thing to do," just the quickest way out of a traumatic experience and to avoid it as much as possible...
And then you find out one of them is nominated for Supreme fucking Court? Okay hell the fuck no, yeah, they're definitely going to say what happened. Before he was a "nobody" who was still privileged enough to likely get away with it (like Brock Turner), but now they're trying to give him one of the most influential positions in the country? Fuck that, he has to be taken down.
Ford and all these other women are absolutely crushing it. I'm really just in awe of them. <3
