why? we've been having this debate for almost 100 years, there's never going to be the push to fix scotus nominations, the filibuster will never be reimplimented, so what's left when the court has been deliberately rigged to one side by judges hand picked by a group who's sole purpose is to rig the judiciary and confirmed by a senate that will do absolutely everything to push a nomination through?
if you pack the court it sets a precedent to the repubs that nothing is off limits so they'll pack more people onto it, not only is this bad for the court politically it also slows down the mechanisms of the supreme court
but nothing is off limits already, they've removed the filibuster on justices, they'll hold seats open until they have a president that they want, they'll even rush votes to prevent damning evidence from being released, we're already there the house is burned to the ground, there's nothing more to set fire to.
A constant battle of upping the size of the court would essentially make it meaningless and a rump institution. Might as well remove it then.
nothing's stopping repubs from doing it when they had a majority. could just push for an amendment to set a static size for the SC.
as long as there is a filibuster it would be very difficult to increase the size of the court further. It only can be done when the house senate and presidency is controlled by a majority and a filibuster proof senate, an almost once in a lifetime chance.
The political fallout would be yuge and we might see another 2010 level election due to it. I think it should be done but only if the GOP are sort of irrelevant like in the 30s or 60s.
