Let me get these straight. Paid mods were still pushed by Bethesda regardless of how much. Beth.net, I have nothing to say about other than what I've heard of it, but if those mods find their way on the nexus anyway, then what's the point of having it beyond console mods? Just because Creation Club shit is there for free for whatever time it is, you say it's about supporting the modders, yet it's "not needed". You could just directly donate to them instead. It's just Bethesda wanting a slice of that mod pie. Creation Club breaking the Script Extenders every update is still horribly inconvenient for everyone involved. "Always Online" being just for one game is almost always testing the waters for more of them, regardless of whether they're SP or MP. By taking the third party devs to themselves they're just gaining the maximum profit from each game. Sure, it might work for them, but I don't want to see the day when every single studio is integrated to a publisher. And FO76 will exactly be exclusive on their storefront on the PC.

This is the problem though... I find Bethesda's recent acts since that 'Scrolls' debacle terrible, but I know I will still buy ES6 because I loved Skyrim so much that I still play it to this day.

This isn't true at all. While Valve liked the idea and facilitated it, Zenimax are the ones who were pushing it, hence why they carried it over in to their own platform with Fallout 4.

People still believe that's why this exists? No, modders only get a lump sum, they don't see a penny more beyond that, and even then, it's designed to make Bethesda money. Thinking otherwise is pretty naive. Bethesda gets money off of the sales, not modders. saying its 'to support modders' is so blind that it's not even funny. Bethesda was the first to do Micro-transactions. The company that runs it all, Zenimax doesn't give a fuck about you, only your money.
Bethesda weren't the first do to Microtransactions. That honor goes to Day 1 Studios/Wargaming Chicago and Microsoft with Mechassault on the original Xbox.

Legally speaking, do they actually have any ground to stand on? If he never unwrapped the game, he never agreed to any TOS prohibiting resale. Part of me wants this to go to court just to see Bethesda get shafted and a legal precedent be set.

Here's an idea: lend the game to the friend while also coincidentally having him lend you $60 of gas money. Both of you say, "Eh, pay me back whenever, it doesn't really matter if you even do." Then tell Bethesda to go scratch.
Doesn't a warranty only go into effect when it's registered and therefore a sealed new copy wouldn't have it's warranty in effect? Or is Bethesda going to use this in a future attempt to crackdown on physical sales? Because by their logic any physical game you have ever purchased was unauthorized because apparently that warranty was in effect while it was in store.
Same company whose lawyers thought Scrolls would confuse people looking for The Elder Scrolls. Even though Scrolls is a different genre, wouldn't be on consoles probably, and people generally refer to the games by their subtitles.
I think the US copyright system is fucked, just another symptom of how bad things have gotten for the people there. Why should a company be able to copyright common words or phrases that have been in common use since forever?

It's worth noting that the Scrolls debacle was not about copyright, but trademark, which is a similar but distinct set of law. Copyright concerns itself with preventing people from stealing and using your stuff without your permission. Trademark concerns itself with preventing people from using names close enough to names you're using that consumers may be confused and believe your brand encompasses this random product or thing made by someone else that you have no control over. I don't think consumers will be fooled by "Scrolls" and think it is a game belonging to The Elder Scrolls franchise, but that's what trademark lawyers are paid to do.
