This genuinely feels like it would be some good lines for a movie script.
Hines explained that the issue was not that Hupp was selling their game second-hand, but specifically that he listed it as 'new'. "All we're saying is if it's a previously owned product, you have to sell it as a previously owned product", he told Eurogamer.
"You could have opened it up," he went on to explain, "played it for five hours, taken whatever inserts or stuff was in there, put it back in shrink wrap and said, 'Hey this is new.' It's not new - you owned it, you bought it, so just list it as a used title. That's it, that's the end of the argument."

🤔
They're still threatening to sue someone for this fucking nonsense
telling him that his listing of a sealed copy of The Evil Within 2 on the Amazon Marketplace was "unlawful"
"You could have opened it up,"... "...put it back in shrink wrap"
If it is still sealed than you can lawfully sell it as sealed
Imagine if you were being threatened with legal action for selling
Sealed in Package Vintage 1975 Gayla Kite Baby Bat 42 " Wing Spa..
Rare Snoopy sealed in package & Woodstock Mini Walker Lot Aviva ..
Cutco, Brand New In Sealed Package #1759 White, D
Super R-Type (SNES RARE) SEALED
the argument was "It was previously owned, therefore not new, you have to sell it as used"
There are products that would sell for thousands SEALED, but for only 1% of that if 'used'.
The difference doesn't matter here specifically, but the precedent that they're setting over semantics is would actually be very terrifying for collectors.
They're using semantics to justify shitty practices, the generally accepted meaning of new is that its unopened. Every product sold on the market has a previous owner which is the supplier.
Yeah, if anything they should've gone to Amazon and said something, not get lawyers involved
Bethesda trying really hard to steal EAs place in the market
I mean there are machines that let you do that, but that's still stupid.
Pete Hines is a slimebag and always has been. He's the dude who said nobody cares about the lore in Fallout because its just a dumb game.
Should be. But customers complain to manufacturer all the time for things like an empty box or fake products inside.
I deal with that as a service rep on Social Media.
To be honest, there is nothing hard with putting it back in a shrink wrap.
And here we go
