It's pretty easy to see how a bunch of students doing a nazi salute for their school prom picture could be punished by the school without violating any first amendment right.
Yeah, I can definitely see that being the case here too. Maybe they are all/mostly neo-nazis, or at least racists, and are using this as a "prank" to express themselves. Maybe half of them are racist and the other half are jokingly going along with it, thinking it isn't serious. And maybe they were all just told by the cameraman "can you raise one of your arms up like you're waving goodbye? just raise it straight and up into the air", and thought "...if you say soooo". With at most couple of them actually being racist, and the rest legitimately just doing it as a joke. There's really no way to know just from the context we have, and especially the story they've told. It's not like they're doing it at a rally or protest or anything like that. They're at a high school, and they all look like they're laughing about it. It could go either way.

Huh, didn't know that. I had to look it up and yeah, looks like it mostly came from neoclassical artwork depicting the gesture starting in the late 1700's. To be fair, though, it does still predate the rise of Fascism, even if there's no documented evidence of the Romans ever doing it. I'm not really on the fence looking at this because all I can see is a punch of teenage boys fucking around in a group photo. When I was in highschool we sometimes did the salute just to fuck pictures up because someone doesn't want that in the picture or it looks stupid. But in the end we're laughing about it because in a general sense we're laughing at Nazis. Through this picture you see a bunch of the boys waving normal, some of them doing nothing, some looking surprised and laughing. Hell even I find myself doing a semi-straight arm wave sometimes to people. I doubt any of them really hold any true beliefs on that shit, who knows. But context matters and the context of this picture is a punch of kid fucking waving to their parents before prom.

Tbh I have no problem with Nazis being punished for openly being Nazis because supporting Nazism is explicitly supporting genocide, and thus encouraging harm. That said, you'll have a metric shit load of kids who don't understand the moral ramifications of even pretending to be a Nazi, nowadays. To a lot of them, it literally is just an edgy joke. I knew a singer of a queer band who, at one point, posted a picture of themselves laughing next to a swastika they drew. Do they genuinely hold racist beliefs/promote genocide? No. But they just made a really (really) shitty joke. When I was in high school, I played a Nazi in the Sound of Music. I posted a picture of myself sieg-heiling on Facebook, and a few years later I came across it again and realized "woah, yikes, yeah, that's awful." IMO it matters that Nazis were a much smaller concern back then than now, but I digress. These kids might literally and genuinely feel its a joke. Will some of those boys grow up with racists beliefs? Sure, you'll unfortunately find horribly racist people peppered throughout newer generations. The school saying "well, free speech" is just weak imo, because it's almost implying they're genuinely identifying with Nazi ideology. Just say "they were making a joke in poor taste," and try to move past with that instead.
My problem with this is that there is a tendency for people to overreact to this sort of thing, so it would be inevitable for people to be prosecuted unfairly based on misunderstandings. A lot of people seem to think that if they don't personally find something funny, then it's not a joke. This article and the Nazi Pug guy are good examples of this. There's a photo of Allied soldiers making fun of Hitler on the destroyed balcony of his bunker after the invasion of Berlin. One guy is standing over the others on the balcony where Hitler gave a bunch of his speeches, giving himself a finger 'stache and doing a Nazi salute while the others look on and laugh at him. Not the greatest comparison, but I wouldn't be surprised if it was meant to come off similarly. I'm picturing a queer person laughing by the symbol of a regime which systematically murdered a lot of their people, sort of saying "Haha, fuck you, we're still here". I dunno, not really trying to make a point, just a thought I had. I'm not real sure I follow, could you elaborate? The Nazis weren't too keen on free speech, even from a purely ideological standpoint.

see where your argument fails is that the likelihood of these kids saying "hey all let's do a Roman salute that we all know predates the rise of facism and subsequent popularity during WW2" is virtually nothing compared to "lol let's do a sieg heil". Come on man.

If we're worrying about useless shit like this and we have full blown news coverage about shit like this and I'm afraid what outrage will happen in the next 5 years.
I think it's more than a bit much to call these people "racists" - edgy jokes are a thing. I wouldn't want this thing to affect them at all if they otherwise grow up to be productive, normal members of society. I'm sure a lot of people here have done something in poor judgement during their high school years, not everyone is unlucky enough to have it go viral.

I've noticed a few more interesting people in the crowd. There are a couple of them who have clenched fists and I have to wonder if they are trying to do a black power gesture instead, or just a cheer that isn't so Nazi. Then there is a kid with BOTH arms up and he's either a super Nazi, super fucking goofy, or he is trying to do a like super hero flying pose. I've noticed a fair few not doing it, like ten or so who just aren't doing anything at all.

Nazism never heavily affected Asia, since everyone was dealing with the Japanese, and the KMT even bought military equipment from the Nazis to fight the communist.
I can see how that may have come across as an argument, but I wasn't really trying to make a point with that post, I just find the history of it interesting and I was fairly drunk when I wrote that so I went on a bit of a tangent. The only real argument I made in this thread was that it's far more likely that they were just trying to get a reaction out of the photographer as opposed to actually being a class full of neo-nazis. They don't really deserve to be punished for that in my opinion, at least nothing severe like expulsion or anything like that.
There will always be people that will hire them. "We just need another mechanic on shift." Or "I just need a plumber. I don't care if you Sieg Heil my fuckin' toilet just fix my shower." There will always be places that just don't care because they're not big enough or the role is so unimportant that it doesn't matter. Now that's certainly a shitty downgrade if you're expecting to be a lawyer or politician but let's be real, plenty of practicing lawyers are thinly veiled supremacists already, and we had plenty of Nazi politicians elected to Congress this year, so they're hardly going to be out of work there too.
