I'm honestly surprised anyone's laying claim to the copyright of this dance, to me it just looks like the kind of thing that awkward kid with no date would do int he corner during Prom.
This guy did it back in 2010. https://www.youtube.com/watch?v=4N-C22u4FfU

Cowboy Jesus, thrown from the bull for our sins.
Yes, but only to a certain degree. Until the most recent case against Epic, I would hardly say there was any precedent for dance moves to be brought up in court in the context of digital representations like this. So to take this case to trial BEFORE that last case was won, would be an incredibly risky endeavor, because you'd be paying for all the legal counsel for a case where there is little precedent. Now that there has been a case won by someone who had the funds to take it to trial, it's much easier for these "little guys" to lawyer up, because now they've got the opinion of the court on their side. It's much less risky. You're thinking of copyright protections for rights management firms.
Mr.Krabs had that shit in 2002, there's no case. https://youtu.be/32tJZvx30Dk
