historically when you dueled you stood so far apart that the chances of actually striking each other was virtually zero, that said if you're burr then you just load and fire again until you hit hamilton
today though pistol dueling is pretty much guaranteed to be fatal

We have a lot of old laws on the books are that either unenforced or inapplicable nowadays. It probably isn't legal to have a duel.

no, its not legal. Even back in the dueling ages, duels were illegal, its just people did them in places where there was no law, such as contested islands between state boarders.
even if it was legal to agree to a duel it would still be illegal to discharge a firearm in the middle of a city
