My argument wasn't that it was a good idea to do, as I stated in that post. Nor was my argument that it was OK because there was no law.
My argument was that you can actually type a sentence on your phone with little to no distraction and looking away because of things like autocorrect and swipe-typing. I do it while walking, or talking with someone and not breaking eye contact.
Don't text and drive, wear your seatbelt, duh. But don't assume that just because you have a phone in your hand that it is a vicious blackhole of attention.

It seems to me that you are trying to qualify the use of a cell and also justify it. It's dangerous and reckless to do. Distracted driving is literally more dangerous than driving drunk.

IIRC the fatal accident happened with the older autopilot that couldn't bounce the radar beams under cars. The reason the crash happened was because the Tesla assumed the trailer was a overhead road sign because it was turning across the lanes and the radars were going under it instead of bouncing off it like a car.

At the time AP didn't use radar independently at all. It was only acted on when the camera verified the object as well. Mobileyes system didn't recognise vehicles from the side. The radar saw the truck as an obstacle but the camera didn't so no action was taken. Radar is now acted upon even when the camera fails to see the object, after Tesla made significant improvements to it.
