The only way you'd get a refund from valve over a steam activated game would by by cancelling a perorder or by never playing your game and at the same time proving that it caused you to develop cancer and get infected with malaria

actually valve has been known to provide refunds if you buy a game just before a sale

In what way does it ruin the point of VAC?
They still need a steam account to play it, they will still be banned for hacking.
But I guess you are thinking that they can just spam new accounts? Well that depends on the player, but it's not like you'll ever have a completely hack-free game anyways.
