Doesn't matter if they honor it (they don't, if you read the law-text Van-man quoted), law always supersedes unless you explicitly sign a contract or other binding agreement.
This is true for any situation in which a consumer interacts with a business, by the way. Consumer rights apply almost identically throughout the market, not only in software, so it's not there to say fuck you specifically to gaming companies or anything.

Yup, the game has a rough load on servers at launch, so its ruined. The game still being good doesn't even remotely matter. Nope.

When you can't play it, you're darn right it doesn't remotely matter.
Edit: Is stability no longer a factor for what makes a game good? Can someone push out an amazing game that nobody can play for more than five minutes at a time and the mere act of launching it will do terrible things to your OS -- and people will still praise it as 'good'?
To put it another way: Is Legends of Pegasus good? Despite that you can't complete the first part of the campaign, it'll crash every five to forty minutes, has a ton of bugs, and so forth?
